Terms of Service
The rules for using PickASunnyDay.

1. Scope and acceptance
These Terms of Service govern your use of the PickASunnyDay iOS App and this website (together, the "Service") operated by Nils Schiwora, trading as Nils Schiwora Trading Services, Ahornstr. 37, 14547 Beelitz, Germany — see the Imprint.
By installing the App, creating an account, or using this website beyond purely informational browsing, you agree to these Terms. If you do not agree, please stop using the Service.
In addition to these Terms, the App Store's standard terms (Apple Media Services Terms and Conditions, including the Licensed Application End User License Agreement) apply between you and Apple. Where those terms conflict with ours on a point Apple is responsible for (billing, account management, refunds), Apple's terms prevail for that point.
2. What the Service does
PickASunnyDay ranks upcoming days by expected sunshine for places you select, so you can plan time outdoors. The ranking is based on third-party weather forecast data and our own scoring of that data.
Weather forecasts are inherently uncertain. The App gives you estimates, not guarantees. We do our best to make the ranking useful, but the further out a day is, the less reliable the underlying forecast is.
3. Eligibility and account
- You must be at least 16 years old to use the App. If your country sets a different age of digital consent under Art. 8 GDPR, that age applies.
- You are responsible for keeping your device and Apple ID secure. We treat anyone signed into your device as you.
- We may decline service to anyone whose use violates these Terms, the law, or third-party rights.
4. Subscriptions ("PickASunnyDay Plus")
Most of the App is free. Some features require a paid subscription called PickASunnyDay Plus. Subscriptions are sold through the Apple App Store. Pricing, billing, renewal, cancellation, refund handling, and free-trial rules are described in the Subscription Terms.
5. Acceptable use
You agree not to:
- Reverse-engineer, decompile, disassemble, or otherwise try to derive the source code of the App, except to the extent this is permitted by mandatory law (e.g. § 69e UrhG for interoperability).
- Use the Service to harass, threaten, defame, or impersonate anyone.
- Use automated means (scrapers, bots) to access the Service in a way that imposes an unreasonable load on it.
- Circumvent any usage limits, paywalls, or security mechanisms.
- Use the Service in violation of applicable export-control or sanctions law.
6. Intellectual property
The App, this website, the "Solly" mascot, the brand name "PickASunnyDay", and all related design, copy, and code are owned by Nils Schiwora Trading Services or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for personal and non-commercial purposes, for as long as these Terms allow.
You retain rights to content you create (for example, notes you save against a planned day). By submitting feedback or bug reports, you grant us a non-exclusive, royalty-free, perpetual licence to use that feedback to improve the Service.
Weather forecast data is provided by Open-Meteo under the Open-Meteo licence and CC BY 4.0 attribution requirements. The iOS App shows this attribution in Settings → Help & About → About & legal and in Acknowledgments.
7. Forecast disclaimer
The App is a planning aid, not a safety service. Do not rely on PickASunnyDay for decisions where weather can cause serious harm — including aviation, marine navigation, mountaineering, severe-weather warnings, or anything where an official meteorological agency should be consulted. For severe weather, use your national weather service (in Germany: Deutscher Wetterdienst).
To the extent permitted by law, we are not liable for plans you make on the basis of a forecast that turns out to be inaccurate.
8. Limitation of liability
We are fully liable for damages caused intentionally or by gross negligence, for damages from injury to life, body or health resulting from a breach of duty by us or our agents, and for any other liability that cannot be excluded under mandatory German consumer law (in particular the Produkthaftungsgesetz, where applicable).
For slight negligence, we are liable only for breach of an essential contractual duty (a duty whose performance makes proper performance of the contract possible in the first place and on whose observance you may regularly rely). In that case, our liability is limited to the foreseeable damage typical for this type of contract, and in any event capped at the amount you paid us in the 12 months preceding the event giving rise to the claim.
We are not liable for indirect or consequential damages outside the cases described above.
This Section 8 applies to all claims, regardless of legal basis, including tort.
9. Term and termination
You may stop using the App at any time. Subscription cancellation is described in the Subscription Terms. Deletion of your account is described on the Support page.
We may suspend or terminate your access if you materially breach these Terms, after a reasonable warning where possible. We may discontinue the Service as a whole with at least 30 days' notice; in that case, we will refund any unused, pre-paid subscription period.
10. Changes to the Service and to these Terms
We may change features of the Service from time to time. If a change materially reduces a paid feature, we will tell you in advance and you can cancel as described in the Subscription Terms.
We may update these Terms. We will notify you of material changes at least 14 days before they take effect in the App or on this website. If you do not agree to the new Terms, stop using the Service before they take effect; continued use means you accept the new Terms.
11. Governing law and jurisdiction
These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer-protection provisions of the country where you have your habitual residence remain unaffected.
The European Commission provides an Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
12. Severability
If any provision of these Terms is or becomes invalid or unenforceable, the rest remains in force.
